1. Acceptance of Terms

By accessing the BITS website at bitsofit.com, engaging our managed IT services, or communicating with BITS via any channel (including SMS/text messaging), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, please discontinue use of our website and services.

2. Services

BITS provides managed IT services, HIPAA compliance consulting, helpdesk support, and related technology services to small and medium businesses primarily in Northern Nevada. Service engagements are governed by separate service agreements or statements of work entered into between BITS and each client.

3.1 How to Opt In

You opt in to receive SMS messages from BITS by:

By opting in, you consent to receive SMS and MMS messages from BITS related to your IT support requests and helpdesk communications.

3.2 How to Opt Out

Reply STOP to any text message from BITS at any time to unsubscribe. You will receive one final confirmation message, and no further messages will be sent. You may re-enroll at any time by texting us again.

3.4 Message Frequency and Content

Message frequency varies. BITS sends text messages only in direct response to your support requests or inquiries. We do not send promotional or marketing text messages. Typical messages include:

BITS's SMS program is available on all major U.S. wireless carriers. BITS and its SMS service providers are not liable for delayed or undelivered messages. Carrier support is not guaranteed. Message and data rates from your wireless carrier may apply.

3.6 No PHI via SMS

Do not send patient names, medical record numbers, Social Security numbers, insurance information, or other Protected Health Information (PHI) via text message. For matters involving PHI, contact BITS through a HIPAA-compliant channel or by phone.

The content on bitsofit.com is provided for informational purposes only. BITS does not warrant that information on this site is complete, accurate, or current. The HIPAA Self-Assessment tool is for educational purposes and does not constitute legal or compliance advice.

You agree not to: (a) use our site for any unlawful purpose; (b) attempt to gain unauthorized access to any portion of the site; (c) interfere with or disrupt the site's operation; or (d) use automated means to scrape or harvest content from the site.

5. Intellectual Property

All content on bitsofit.com, including text, graphics, logos, and software, is the property of BITS or its content suppliers and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without express written permission.

6. Limitation of Liability

To the fullest extent permitted by law, BITS shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our website, services, or SMS program. BITS's total liability for any claim shall not exceed the amount paid by you to BITS in the three months preceding the claim.

7. Governing Law

These Terms are governed by the laws of the State of Nevada, without regard to conflict of law principles. Any dispute shall be resolved in the courts of Washoe County, Nevada.

BITS may update these Terms at any time. Changes are effective upon posting to this page with an updated effective date. Continued use of our services or SMS program constitutes acceptance of the updated Terms.
